The Imperial Farman

WE, PAHLAVI THE EMPEROR OF IRAN, MOHAMMAD REZA SHAH PAHLAVI


Having regard to the provisions of the Constitutional Law, do hereby command:

Article 1.

The Health Corps bill, enclosed herewith, passed by the Majlis and the Senate, shall come into effect.

Article 2.

The Council of Ministers is charged with carrying it into effect. Dated this 2nd April 1964.


The Health Corp Bill

Article 1.

In order to extend public health and radical care throughout the villages and rural regions of Iran, Health Corps being composed of Medical Group and Medical Aid Group will be formed as follows:

a. The Medical Group will be formed of army conscripts who are found, professionally qualified to practice in the field of medicine and sanitation, comprising of Doctors of Medicine, Dentists, Pharmacists, Veterinary Surgeons, Sanitary Engineers, and generally speaking all university graduates whose services would be deemed by the Minister of Health, subject to the provisions of the by-laws of this bill to be approved by the Council of Ministers, effective and necessary in performance of medical and public health duties, whether they have passed a proficiency course in such fields or otherwise.

b. The Medical Aid Group will be formed of conscripts with a High School education who will be given a course of special training to fit them for medical aid services.

Note: The Veterinary Surgeons coming under these provisions, but not required by the Ministry of Health, will be put after military training, at the disposal of, the Ministry of Agriculture.

Article 2.

The Medical Group and the Medical Aid Group will undergo military instruction and technical training in the Military Training Centers in accordance with the law as approved by the Ministries of Health, War, and Education, and the candidates will receive their respective grades upon the completion of training and the successful passing of the examinations.

Article 3.

The granting of any type of license to practice a profession, as well as permission to leave the country for advanced professional study or completing scientific learning, is subject to having rendered military service, unless the applicant is conditionally exempted from military service, the terms and conditions of which are provided in the by-law of this bill.

Article 4.

The budget required to enforce this bill will be provided as follows:

a. During the course of training, salaries and advantages will come out of the budget of the Ministry of War.

b. Training Centers required for the basic training course will be provided by the Ministry of War and put at the disposal of the Ministry of
Health, but if such centers are not available, the Ministry of Health will supply the expenses required to establish such centers from the State Development Budget and put them at the disposal of the Ministry of War.

c. Upon the completion of basic training, all salaries and advantages as well as all other expenditures thereof, as to transport facilities, technical equipment, medicines, etc. will be secured and paid out of the State Development Budget credits which will be put at the disposal of the Ministry of Health.

Article 5.

The service rendered by the personnel of the Health Corps will be deemed as services rendered in the -Imperial Armed Forces, and regarded as services under the flag. From disciplinary and penal aspects, the Acts and Regulations of the army affecting officers, non-commissioned officers and conscripts govern the Corpsmen. From the health services aspect, the provision of the laws and statutes of the Ministry of Health will govern the Corpsmen.

Article 6.

All ministries and other state institutions are bound to fill their staff vacancies, at the first instance, and in case of equality of qualifications, from such staff that have rendered their services in the Health Corps.

Article 7.

The Ministry of Health shall draw up the by-law to enforce this bill, and upon obtaining approval of the Ministries of War, Interior and Education, and approval finally of the Council of Ministers, put it into effect.

Article 8.

The Ministries of Health, War, Education and the Interior are in charge of enforcing this bill as enacted into law. Comprising eight articles and one note, it has been enacted by the Majlis on Sunday 9 February1964, and by the Senate on Monday 27 April 1964.


Implementing Statute

Implementing Statute of the Health Corps

Subject to the proposal of the Ministry of Health, 16 August 1964, which is approved by the Ministries of the Interior, War and Education by virtue of the authority vested in them according to Article 7 of the Health Corps Act, the Council of Ministers in the sitting held on August 18, 1964, approved the implementing statute of the Health Corps Act, comprising 18 articles and 9 notes as follows:

Article 1.

The Medical Group of the Health Corps shall be formed of the following recruits:

a). Doctors of Medicine, Veterinary Surgeons, Dentists, Pharmacists, Sanitary Engineers and Physicians,

b). Holders of Licentiates and higher degrees in the following fields - Parasitology, Bacteriology, Laboratory Technique, Nursing, Nutrition, Radiology, Health Education, Social Work, Environmental health Sociology, Statistics and Hospital Administrators.

Note. Those graduates as provided in paragraphs (a) and (b) who have not completed their thesis will also be called to service in the Health Corps.

Article 2.

Conscripts will be exempted from service in the Health Corps on the following grounds:

a) Graduates, as provided in Article 1 of this statute, who subject to the opinion of the Army Medical Supreme Council, which is formed in company with representatives of the Ministry of Health, are found physically unfit to render proficient service in the Health Corps,

b) Supporters of families whose absence in service would cause extreme hardship according to the provisions of the Public Conscription Act.

c) Students who at the date of sanction of this statute are enrolled in a course of study at a school of higher learning, to the end of such course only.

Article 3.

The conscripts required for service in the Health Corps will be drawn after supplying the needs of the army -- a detailed list and description of such remaining conscripts to be sent to the Ministry of Health. And as for medical aids, the quota of high school graduates for the Health Corps will be determined by the mutual consent of the Ministry of Health and Education.

Article 4.

The Department of Public Conscription is bound to notify, two months before the commencement date of recruitment, the Ministries of Health, Education and War, the approximate number of conscripts, which will be made available for the Literacy Corps and for the Medical Group of the Health Corps.

Article 5.

The Department of Public Conscription will send the conscripts nominated for service in the Health Corps to the Military Training Centers, which have been allocated for that purpose.

Article 6.

Food, lodging, salaries and advantages of students in the Health Corps will be equivalent in all respects to the lodging, food, salaries and advantages of the conscript officer candidates of the Imperial Armed Forces.

Article 7.

The course of study for students of Health Corps will total six months, which will be allocated to basic military and public health training.

Note 1. The detailed program of training of students of Health Corps will be prepared and put into force by collaboration of the commander of the Literacy, Health, and Development and Extension Corps and the representatives of the Ministries of Health and Education for each term.

Article 8.

The uniform of the students of the Medical Group of the Health Corps will be, during the period of learning, equal to the uniform of the students of the conscript officer's cadre, and the uniform of the students of the Medical Aid Group will be equal to the uniform of conscript high school graduates. After successful completion of training, the Medical Group will wear the uniform of officers in the Imperial Armed Forces, while the Medical Aid Group will wear the uniform of the Literacy Corps, both groups wearing the insignia of the Health Corps.


Article 9.

Candidates for the Health Corps who are found disqualified for moral reasons before completing their course of training, as a result of which they would not be fit to render proper service, provided that such disqualification is confirmed by the Council of the Training Center, will be surrendered immediately to the nearest military unit to serve as a private for the remainder of their service under the flag.

Note. The Council of the raining Center will be formed of five persons, i.e., the Commander of the Training Center, two military lecturers and two health lecturers.

Article 10.

Training will be divided into military and medical courses, with the minimum requirements for successful completion of the final examination to be a mark of not less than 10 out of 20 for each group of courses, while the average total mark of both courses must not be less than 12 out of 20.

Note 1. Candidates whose hours of absence by any reason whatsoever during the training period exceed 1/6th of the total hours will be deemed to have failed, except where the Council of the Training Center subject to the ability and aptitude of a student, permits him to take part in the final examination.

Note 2. Students who have absented themselves from more than 1/20th of the total hours of training inexcusably will be deprived of participation in the final examinations and will be deemed to have failed. The Council of the Training Center will determine an excusable absence.

Article 11.

Candidates of the Medical Group of the Health Corps will, upon passing the final examination, subject to the provisions of the laws, be awarded the grade of second lieutenant.

Article 12.

Candidates in the Medical Aid Group of the Health Corps will be awarded, upon passing the final examinations and subject to the order of priority and the results of examinations, the ranks of 1st, 2nd, and 3rd sergeants respectively.

Note. The ratio of the above grades as provided in this article will be, for the Medical Aid Group candidates of the Health Corps, in proportion to 5, 10, and 85 percent of the number of candidates at each Training Center.

Article 13.

To put into effect the provisions of the Health Corps Act, Article 2, candidates to the Medical Group will, upon successful passing of the final examination and upon application of the Commander of the Literacy and Health Corps, be honored with an Imperial Command of admission to officer's grade, and with respect to candidates to the Medical Aid Group, given a certificate of the success in passing the final examination and being admitted to sergeant's grade, signed by the Commander of the Division or relevant garrison.

Article 14.

Candidates to the Medical Group who fail will be admitted to 1st and 2nd non-commissioned officer grades, and will be sent subject to the provisions of this statute for service in the Health Corps, and candidates failing in the Medical Aid Group will be dismissed immediately from the service and will be returned to their conscription district with a "Ready for Service" booklet, to take part in the next recruitment for high school graduates. Such conscripts, without enjoying the advantages contained in the resolution of the Council of Ministers dated 2nd July 1961, in connection with the exemption of matriculated conscripts in excess of Army requirements, shall take part immediately in the next course of training for the Literacy and Health Corps. If, however, they fail for a second time, they will be sent as a private for a full tour of military service.

Article 15.

Upon completion of training, the conscripts will be introduced to the Ministry of Health, and all officers and non-commissioned officers of the Health Corps will receive a ministerial order from the Ministry of Health determining the place of service and will be sent to such place for service.

Article 16.

With respect to infringement of the laws and penalties - the Health Corpsmen will be treated in the following manner:

1. Medical malpractice will be treated according to the Regulations of the Ministry of Health and due punishment will be inflicted.

2. Disciplinary offences will be reporter) by the relevant Health Department to the nearest commander of, the nearest garrison stating the type of offense. The commander of the garrison will inflict punishment according to the provision of the laws.

3. Criminal acts committed by officers or non-commissioned officers shall be declared to the nearest garrison and the offender treated according to the provisions of the Criminal and Penal Code of the Army.

Article 17.

For officers and non-commissioned officers of the Health Corps, a booklet of termination of service will be prepared by the Training Centers and/or by the relevant districts, and will be sent through such Centers to the Ministry of Health to be awarded upon certification of the Ministry of Health.

Note 1. The termination of service booklet will be according to the form supplied by the Department of Public Conscription and with the approval of the Ministry of Health.

Note 2. The behavior of the officers and non-commissioned officers during their service in the Health Corps will be recorded on a particular page of the termination of service booklet, and such officers and noncommissioned officers may enjoy the privileges contained in Article 6 of the Health Corps Act, provided that the contents of that page indicate good service.

Article 18.

The statute comprising l8 articles and 9 notes was drawn up to enforce the provisions of the Health Corps Act, Article 7, and was approved by the Council of Ministers on the 16th of August 1964, and is enforceable.
